Director of Public Prosecutions (DPP) Noordin Haji has accused the judiciary of protecting errant judges against prosecution.
Speaking during a press conference on Saturday, Haji claimed the judiciary has been shielding some judges and magistrates linked to various malpractices while in line of their duty.
He made reference to Mombasa Principal Magistrate Edgar Kagoni whose case was quashed after the loss of heroine exhibit valued at Sh30 million.
He decried that unless the judiciary cooperates with his office, it will be hard to attain a crime-free nation.
“If the Judiciary says they cannot be investigated, then police officers and governors and other officials will also say the same thing…how would that work? Yet someone broke the law and we have evidence that it was criminal,” posed Haji.
According to Haji, the magistrate stored the drugs in a courtroom intentionally, so that they can disappear, and bring to an end the case against Kagoni.
“Drugs vanished, and this magistrate knew clearly that drugs cannot be stored in a courtroom…drugs, weapons, guns and bombs are supposed to be placed in police strong rooms. That is the law," he said.
“We have evidence that the magistrate did that intentionally so that the drugs can be stolen. That is the evidence we want to present before court, so why should we be blocked from doing it?” he added.
