Migori Governor Okoth Obado has filed an application in court seeking for the disqualification of the late Sharon Otieno's family lawyer from the court proceedings.
In his application, Obado argues that Professor George Wajackoyah, who is representing the late Sharon's family, should be disqualified from the case, on grounds that he is in possession of privileged information.
According to Obado, Prof Wajackoyah was initially set to represent him in the case, but his name was dropped at the last minute.
He said he had discussed a lot with Wajackoyah, and was positive he was the right person to represent him, judging by his experience dealing with the DPP and the DCI.
Obado; who is one of the suspects in the murder of Sharon, claimed Wajackoyah could use the information against him during the trial.
“Wajackoyah showed me correspondence between himself and the two offices and I was convinced that indeed he had good knowledge in criminal law practice. He further confirmed that the two offices nevertheless cleared him to represent me,” Obado said as quoted by Star.
“The advocate took serious issue with the omission of his name from the quorum and informed me as much. In the subsequent court appearance, he came to court and introduced himself as the advocate for the victims. He continues to be on record for the victims to date,” he added.
The application was set to be heard on Wednesday, but was postponed to Monday next week after one of the lawyers missed court.
