Celebrated lawyer Ahmednasir Abdullahi was on Sunday involved in an online clash with former Justice and Constitutional minister Martha Karua over a court ruling.

The two differed on a ruling issued by Justice Mumbi Ngugi over graft cases involving governors. The judgment has been subjected to public debate.

According to Justice Ngugi, governors charged with graft should step aside until their cases are heard at determined by court, a move which Ahmednassir disagrees with.

"Justice Mumbi's judgment is POPULIST and will be WELCOMED by the MIGHTY...and POWERFUL...but it's TOTAL SUBVERSION of the law and she MUST be held to account...pleasing the POWERFUL is not part of judicial function...the last time I checked the MANUAL," he said.

"It will be CELEBRATED by all those who GRUDGINGLY accepted devolution. It's the FINAL NAIL in the coffin of developed units. Chapter 6 has 8 Artcles, 73 to 80...which one remotely requires a Governor to resign if charged with criminal offence?...NONE," added the former JSC member.

But the former Gichugu MP dismissed Ahmednasir, arguing that the ruling is in compliance with Chapter Six of the constitution which gives threshold for integrity of public officers.

Further, she added, once governors are dragged to court, the constitution allows their deputies to assume office. She asked for a date to battle with Ahmednasir over the matter.

"Unwarranted criticism of a great judge whose professionalism, integrity and fidelity to the law is beyond reproach," she said.

"That is if the meaning of devolution is exempting suspects from the requirements of chapter six, otherwise in the absence of a governor the deputy acts," Karua added.
