The High Court on Tuesday barred the National Treasury Cabinet Secretary, Ukur Yatani, from implementing the proposed 50 percent budget cut on the Judiciary.

According to K24,  Justice James Makau said that the new directive will not be put into place until the hearing and determination of a petition filed by the Law Society of Kenya (LSK). 

He also ordered the Judicial Service Commission (JSC) to table a report indicating how the budget cut will affect its operation if adopted at the end of the day.

Commissioner Macharia Njeru of the Judicial Service Commission had raised concern over the directive on the budget cut. 

He had alluded that the budget cuts are likely to affect the operations of the arm of the government. He asked the government to reinstate the budget with immediate effect to create room for operations. 

“This is unacceptable coming against a backdrop of the backlog of cases that the Judiciary is grappling with,” said Njeru as quoted by KBC

He also lamented that the proposed cut is not only ill-motivated but also ill-driven. He argued that the cut of the budget will affect the general operations of the commission in the long run. National Assembly Majority Leader Aden Duale has, however, dismissed claims of budget cut.
