John Njeru who was serving as PPO in Rift valley and Nyanza had to accept the order by Judge Justice Sila Munyao of the Environment and Lands Court. The Judge ordered the title deeds to be revoked and presented to the government offices as soon as possible.

Judge Munyao denoted that the ruling made on November 28 which in which the former commissioner was allocated the land was wrong as the land was meant for public use.

''The plaintiff did not give any pleadings in the suit for compensation and the defendants didn’t have an opportunity to give views on the same. Therefore, I cannot give any orders concerning compensation,” Judge Justice Munyao was quoted by Standard

Mr. John had filed the case against Commissioner of Lands, Nakuru Teachers Primary School Committee, Municipal Council of Kenya, Nakuru Teachers Housing Co-operative Society Limited and five other stakeholders on June 4th, 1994. The judge ordered that Mr. John pays a cost for the suit.

The former commissioner denoted that he had paid sh 526,845 to own the 5-acre land but later on realized that the measurements of the land were 8 acres.

“I had paid for five acres but later realized that the land measured eight acres. I was asked to surrender the previous lease and be issued with a new one but to date, I have not been issued,” said Njeru

Defendants denoted that they had legally acquired the land after NTHCS gave instructions for schools to be constructed. They also added that there are three schools located on the land; Nakuru Teachers Primary School, Nakuru Teachers ECD Centre, and Natewa Secondary School hence the title deed should be revoked.
