During his tenure as a Member of Parliament for Kabete Constituency in 2012, Waititu was accused of making inciting comments said to cause ethnic tension among residents.

The outspoken politician was accused of making hateful remarks against the Maasai community living in the constituency.

The then Director of Public Prosecutions (DPP) Keriako Tobiko ordered for the arrest of Waititu, arguing his remarks caused feelings of hatred and hostility against the Maasai community.

Waititu is said to have made the remarks after a street child was killed by one of the Maasai security guards in the constituency. The street kid had been accused of stealing a chicken in Kayole estate.

Waititu was criticised over the remarks, with the then Internal Security Minister Kato Ole Metito also calling for his arrest.

He later apologised over the remarks, following further criticism from President Uhuru Kenyatta, who was deputy prime minister at the time.

Waititu had previously been arrested for leading youths into protests against the demolition of shanty houses in the constituency.
