The hearing of a case where four Administration Police (AP) officers and a civilian are charged with the murder of lawyer Willie Kimani his driver Joseph Muiruri and client Josephat Mwenda has once again stalled.
The hearing failed to proceed on Tuesday after lawyer Cliff Ombeta representing three of the accused persons failed to appear in court.
Lawyer Sam Nyaberi representing Ombeta told trial Judge Jessie Lessit that Ombeta had been given three more days three more of duty by his doctor.
“I have instructions to apply for adjournment, Ombeta who is representing three accused persons is not able to conduct this matter. The doctor has recommended for three more days off duty. I kindly ask this court to indulge us,” Mr Nyaberi told the Judge as quoted by Citizen Digital.
The prosecution did not oppose the application to adjourn the hearing.
“I have seen the doctor’s letter and the nature of illness. I don’t wish to oppose the application for adjournment. I pray that this matter proceeds on Thursday,” Deputy Director of Public Prosecutions (DDPP) Nicholas Mutuku told the court.
Justice Lessit in her ruling said the hearing will resume on October 7.
The accused AP officers are Fredrick Leliman, Stephen Cheburet, Sylvia Wanjiku and Leonard Maina Mwangi.
The fifth accused is police informer Peter Kamau alias Brown.
The prosecution has so far presented 38 witnesses in the case that is nearing conclusion.
