Amani National Congress (ANC) nominated Member of Parliament Godfrey Osotsi has declared a legal war after the High Court ruled against him.
The latter is involved in a battle for party's Secretary General slot with Barrack Muluka who is currently holding the seat, and in whose favour the ruling was made.
In her ruling, Justice Cecilia Githua overturned an earlier ruling by the Political Parties Dispute Tribunal that had reinstated the lawmaker.
“The PPDT failed to consider whether Osotsi had exhausted the Internal Dispute Resolution Mechanism (IDRM) of the party,” the Judge was quoted by the Tuesday Standard.
But Osotsi now says that he will appeal the matter at the higher appellate court.
"We are going to appeal the ruling at the Court of Appeal," said the lawmaker who seems to be having more problems with the former Deputy Prime Minister Musalia Mudavadi-led party.
He was recently expelled from the party over what the party termed as misuse of oublic funds ahead of the 2017 polls.
He has also bee accused of disloyalty by some party members , considering that he has been seen to be more closer to the Orange Democratic Movement (ODM) side.
The case is still in court.
