Renowned lawyer and socio-political commentator Donald Kipkorir has weighed in on the notice that was issued by Justice Onyiego, explaining why he failed to administer the oath of office to Kiambu Deputy Governor James Nyoro.

Writing on Twitter on Thursday, Kipkorir faulted the basis on which the justice postponed the swearing-in ceremony, saying that the law did not envisage such a postponement or delay.

" Notice below by Justice Onyiego has no Constitutional & Legal basis. Article 182 of the Constitution doesn’t give any conditions for Deputy Governor assuming office on vacancy in the office of Governor ... The Article doesn’t envisage an interregnum of even 5 minutes ..." The lawyer wrote.

The deputy governor of Kiambu had been scheduled to take the oath of office on Thursday but that did not happen in spite of the platform being set for the ceremony.

This comes after the impeachment of Ferdinand Waititu by the Senate after trial on the strength of 3 counts of corruption.

Lawyers spent the better part of Thursday arguing about whether it was legally right for James Nyoro to be sworn in a day after his boss's ouster.

A section of lawyers led by Elgeyo Marakwet Senator Kipchumba Murkomen held the view that Waititu's deputy cannot be sworn in until after 10 days.
