Former Chief Executive Officer (CEO) of the Independent Electoral and Boundaries Commission (IEBC) Ezra Chiloba has moved to court to challenge his dismissal.
This lawsuit which comes approximately a year since he was sacked, was taken to the Employment and Labour Relations Court by Chiloba's lawyers.
According to a report by Daily Nation, Chiloba through his lawyers Wandabwa Advocates is demanding for a compensation of Sh52.5 million.
“The claimant’s claim arises from a series of actions by the Respondent (IEBC) that were illegal, irregular, unfair and unjustifiable which can be categorised into (1) compulsory leave (2) suspension and (3) termination,” a memorandum of claim from Chiloba read as quoted by Nation.
He pointed out that the decision to send him on compulsory leave was full of irregularities citing that only three commissioners were present during the decision making instead of the required five.
The former IEBC CEO also argues that he was never informed officially in writing that a meeting was held to discuss his compulsory leave.
In the petition, Chiloba claims the decisions by the electoral body defied laws.
“The claimant was not afforded an opportunity to be heard regarding the intention to send him on compulsory leave, before it was effected. The decision to send the Claimant on compulsory leave lacked a legal basis as there is no provision in the Human Resources and Administration Policies and Procedures Manual that provides for compulsory leave,” he stated in the petition.
