Mombasa-based tycoon and suspected drug baron Ali Punjani will not be returning to the country anytime soon, his lawyer Jared Magolo has said.
He has since postponed his return date twice, with the police keenly waiting to nab him on arrival, with Magolo now saying that he is comfortable in India after his heart surgery.
He had applied for an anticipatory bail, which the lawyer said that he is no longer keen on after it was rejected by Lady Justice Farah Amin.
His troubles began after being named as one of the leading drug Lords in Kenya, by Indian druglord Vijay Goswami who gave him away in a New York court last month.
Also a state witness in the Baktash and Ibrahim Akasha case, Goswami fingered Punjani as the other leading drug lord, agreeing to also testify against him.
He said that Punjani, who has investments across the region, was the chief rival of Baktash Akasha who pleaded guilty before Justice Victor Marrerro and slapped with a 25-year jail term.
This resulted in a raid at Punjani's Nyali home where the police carted away some coins, title deeds and personal items, which he has since sued the state for confiscating his belongings.
Also found were electric gadgets and cheque books.
While his lawyer has cited his health issues, there are reports that he could be taking his time to negotiate with the police on his terms of surrender before trooping back.
