Nairobi county government currently in an awkward leadership position occasioned by the suspension of Governor Mike Sonko by the court over graft allegations, the city's former Deputy Governor Jonathan Mueke believes there is a way out to ending the current stalemate.
Mueke through his Facebook page said that currently, the Speaker cannot act as Governor as there is no vacancy in the office of governor.
" The Speaker of the County Assembly cannot act as the governor as there is no vacancy in the office of Governor, Constitution Article 182 (4)," reads a post by the former deputy governor.
In a list of point titled "TO GET NAIROBI COUNTY BACK ON TRACK" the former deputy governor says that first, the governor's office should be declared vacant, as written under article 181 and 182(a) of the constitution.
By so doing, he says that the Speaker of the County Assembly will then take over the Governor for a period of 60 days.
"1. Create a vacancy in the Office of the Governor - Constitution, Article 181 and 182 (1). After which the Speaker of the County Assembly will act as Governor and an election for the office of the Governor held within 60 days - Constitution, Article 182(5)," he proposes.
Then he adds that the president should suspend the county after which an election will be held for all county elective positions.
"2. President to suspend the County - Constitution, Article 192(1)(b).After which we have an election for the Governor and all 85 elected MCA's - Constitution, Article 192(6), " he adds.
According to Mueke, as it stands, the Nairobi County government cannot execute its roles as most of those functions are vested in the executive arm of government which is incomplete without the governor.
Mueke's comment comes at a time when Sonko is facing a serious headache after nominating his deputy, a move that has irked the Director of Public Prosecutions Noordin Haji who has threatened to move to Court.
