It is now clear that the country may head to a referendum ahead of the 2022 general election.
This is after the Independent Electoral and Boundaries Commission (IEBC) cleared the way for 'Punguza Mizigo' Bill after it verified over 1.2 million signatures of registered voters who backed the proposal which seeks among other things, creation of a single seven-year presidential term.
The Building Bridges Initiative (BBI), which has President Uhuru Kenyatta and ODM leader Raila Odinga's blessings, is also reported to be in the final stages of formulating a constitutional amendment bill which will be subjected to a plebiscite.
However, lawyer Dr Miguna Miguna and former presidential candidate Prof James Ole Kiyiapi have warned that Kenyans should not change the supreme law to accommodate ambitions of certain individuals.
"Let me repeat a piece of advice I gave Raila Odinga in 2009 but which he disregarded to his peril: Draft a Constitution as if you are doing it for your worst enemy. Restrain the Executive and everyone holding public office. Make everyone fully accountable and equal," Miguna tweeted on Thursday.
Expressing similar sentiments, Kiyiapi said it will be a mistake for the country to change the 2010 Constitution, which is barely 10 years old, to create positions for a particular group of Kenyans.
"Unfortunately, we are just about to repeat the same mistake - amending the Constitution with certain individuals in mind. The more we talk of change the more we remain in the same spot!" posted the former Assistant Minister who is also Restore and Build Kenya party leader.
Various politicians have proposed an extension of the Executive by the creation of Prime Minister post who will have two deputies.
