President Uhuru Kenyatta’s cousin Ngengi Muigai has moved to the Court of Appeal seeking to get back a 443-acre piece of land he lost over loan arrears.

Muigai through his lawyer Marete Githinji wants the case heard by a five-judge bench as he seeks to get back the piece of land which is in Kiambu County.

The land in question which is valued at Sh3 billion was sold by KCB Bank in 2007 after Muigai defaulted on a loan and KCB was given the right to auction the land.

The case had dragged on for 25 years after Muigai appealed the 2007 ruling and in 2017, a three-bench judge at the Court of Appeal ruled that the case had to close to protect the integrity of the court and KCB which lawfully sold the land.

Lawyer Githinji however on Thursday told the court that his client has obtained new and compelling evidence that could reverse the ruling by the Court of Appeal.

“The issues we will be raising are so serious because they are likely to affect several judgments issued by this court on the matter,” Githinji said as quoted by the Nation.

While receiving the file, Judges Roselyn Nambuye, Milton Makhandia and Jamilla Mohamed directed that it be presented to the President of the Court of Appeal to consider the request and also the request for a five-judge bench.
