Estranged Migori Governor Okoth Obado will wait until 24th October to know the fate of his bail application, Justice Jessie Lessit has said.
The defense team led by retired Judge Nicholas Ombija put a spirited fight to rescue Mr. Obado, who will now be a state guest for the fourth week over the murder of his girlfriend Sharon Otieno.
In his submission, Ombija insisted that Obado has a right to bail like any other person accused of murder.
"They have not proved why he should continue being in jail. He is not mentioned anywhere directly in the murder case," he said.
But prosecutors led by Jacob Ondari insisted that Mr. Obado can use his influence as governor to tamper with investigations.
Mr. Ondari submitted that the accused is directly linked to the controversial murder given that he was allegedly the boyfriend to the deceased.
"He has power to sabotage investigations. The right to bail is not absolute. We have to consider victims as well," he said.
The latest development means that Obado will still be at Industrial Area prison even during the day Sharon will be buried in Homa Bay.
Ms. Otieno, whom the state insists that her death was orchastrated by Governor Obado, was abducted before her mutilated body was discovered at Kodera forest early September.
Also to await for Justice Jessie Lessit's ruling on bail are Michael Oyamo and Caspal Obiero, both who are workers at Migori County.
