Kiambu Governor Ferdinand Waititu's application to gain access to the county offices hit a wall on Wednesday.

Judges directed him to wait until the judgement of his appeal to regain access to county offices is rendered on December 20.

The court in its directive argued that the embattled Kiambu Governor had already appealed against the court order barring him from accessing office.  

Waititu's lawyer Tom Ojienda told the court on Wednesday that there were urgent matters that needed to be attended to at the county before the judgement of an initial appeal.

The court papers presented to the court termed Waititu's failure to access office as unconstitutional.

“The Office of a Governor of a County Government is a crucial portfolio and failure to access office not only constitutes an unlawful/unconstitutional removal from office on his part but is also a recipe for instability in the Governance Structure of the County as the current Deputy Governor, Hon. James K. Nyoro has since purported to ‘fill the vacancy’ that was created by the Order of the Court,” the court papers read.

Waititu further sought to have the court limit the powers of Kiambu Deputy Governor James Nyoro who has taken over the county due to Waititu's absence from office.

Anti-corruption court magistrate Lawrence Mugambi issued an order that prevented Waititu from gaining access to Kiambu county offices until a Sh588 million graft case that he is involved in is determined.
