Gatundu South MP Moses Kuria was on Friday, acquitted on incitement charges levelled against him.

He had been accused of issuing distasteful utterances targeting ODM boss Raila Odinga.

The High Court in its ruling stated that the prosecution had failed to provide sufficient evidence to prosecute  Kuria. 

Chief magistrate Francis Andayi said the video clip presented before the court was sourced from social media and no evidence was used in the mainstream media.

"The video was purely in Kikuyu and the prosecution failed to avail a Kikuyu translator," stated Andayi.

The Prosecution told the court that utterances made by the second term MP were "desirable to bring death and physical injury to people".

The controversial lawmaker was accused of using abusive words against Raila on June 26, 2017, at Gatundu stadium in Kiambu County.

Speaking to the press after the ruling, the Kuria revealed that this is the third case he is being acquitted of and still he has one pending case in court.

"The case was during the repeat elections. The magistrate found that they could not prove the case. The case has been there since 2014. It is my third case to be acquitted. I have one more for 2015," said Kuria.
