Ken Okoth's family had been asked to wait until a paternity case filed by Nairobi MCA, Anne Muthoni Thumbi is determined.

Thumbi had alleged that she sired a child with the late lawmaker and wanted a DNA test conducted.

The court has since ordered the pathologists to take DNA samples from the body of the deceased before today 4.00pm and cremation plans to continue as agreed.

Dunstan Omari,  who is representing Muthoni, said both parties had agreed to resolve their differences.

The son of the MCA will be allowed to attend the burial.

“We resolved that this is a family matter and will be resolved as such.  The cremation of the body will proceed as planned but after DNA samples are picked from the body of the late Hon. Ken Okoth at Lee Funeral Home,” Dunstan said.

Okoth’s mother Angeline Okoth, his wife Monica Okoth, and Lee Funeral Home were listed as respondents of the case.

During the memorial service of the late Okoth at Nairobi Moi Girls High School, Nairobi Governor Mike Sonko said that he knew Anne very well and was ready to defend her over the case.

“Ken will not forgive me if I don't save the situation. Ken fell in love with a nurse called Anita from Sonko rescue team. In 2017, he asked me to help him nominate his second wife to the county assembly and out of respect I did nominate her - Sonko at Ken Okoth's memorial service,” he said.
