Gatundu South MP Moses Kuria has been denied anticipatory bail in a high profile case where he faces charges of assaulting a woman.
The embattled MP had claimed that the police at the Kilimani Police Station had threatened him with arrest.
The denial of the anticipatory bail now means that the governing Jubilee legislator can be re-arrested.
Kuria has claimed that he is being persecuted because of the position he has taken on a raft of political issues including the Building Bridges Initiative (BBI).
He was arrested last week and spent the weekend at the Kilimani police station even after he had met the conditions of him being released on bail.
"It is dishonourable for the DPP to violate the rights of an accused person and still prosecute the person," his legal team led by Kandara MP Alice Wahome submitted.
Leaders allied to Deputy President Dr William Ruto have, by and large, rallied behind the Gatundu South MP.
Kuria, who is no stranger to spending time behind bars, had expressed fears that he was in the danger of being re-arrested, something that appears not to have swayed the court.
