Lawyer Donald Kipkorir has explained what it means for Kiambu governor Ferdinand Waititu following a court order asking him to keep away from his office.

In a tweet on Wednesday, Kipkorir indicated that the order simply means Waititu has been restricted to perform duties of the governor, and not the access of office buildings.

"Court Order that Ferdinand Waititu keep away from Office is as clear as the rising of the sun! “Office” is not restrictive term: it means duties & responsibilities of Office Holder. Waititu is stopped from in any way purporting to be Governor Of Kiambu till end of his trial," tweeted the lawyer

Magistrate Lawrence Mugambi after granting Waititu Sh15million cash bail or a bond of Sh30million further ruled that the county boss should not access his office located in Kiambu town until the end of the trial.

The governor, his wife Susan Wangari and eight county staff on Monday were charged with six counts over an Sh588 million irregular tender issued during procurement for the upgrading of various gravel roads to bitumen standard.

Waititu has since moved to High Court seeking the review of the bail terms given arguing that being barred from accessing office is violating the law.

Justice Mumbi Ngugi who last week barred Samburu Governor Moses Lenolkulal from accessing his office stating that Section 62(6) said; "Would it serve the public interest for him to go back to the office and preside over the finances of the county that he has been charged with embezzling?"
