Ethics and Anti-Corruption Commission will no longer invade and search or evaluate properties owned by former Nairobi Governor Evans Kidero, High Court has ruled.

Justice Hedwig Ongudi barred EACC until a case filed challenging the commission's alleged harassment aimed at suffocating Kidero is heard and determined.

Lawyer Tom Ojienda, acting on behalf of Kidero, had moved to High Court and Certificate of Urgency to challenge EACC's alleged poor conduct.

Prof. Ojienda also argued that EACC had disregarded a previous court order barring it from searching properties owned by Kidero or his proxies.

“EACC claims it is undertaking investigations and valuations on the properties and establishments, and in the process has sought to register restrictions on some of the properties without giving sufficient notice to Dr Kidero or the companies as required by law,” says lawyer Ojienda.

The former county boss is accused of orchastrating major graft cases within City Hall running into billions of shillings.

In September, he was arrested twice over sh200 million graft related cases but was released on bail pending hearing.

His successor, Mike Sonko, has often accused him of orchastrating fraudulent activities that allegedly saw the county losing billions of shillings through dubious tenders.
