Homa Bay Governor Cyprian Awiti has announced that he will appeal his August 8 reelection annulment at the Supreme Court.

The Governor suffered a blow when the Court of Appeal on Thursday upheld an earlier High Court invalidation of his reelection.

He said that the decision was arrived at after consultations with his party leader  Raila Odinga.

"After consultations with my party leader, I am proceeding to the Supreme court to appeal the judgement of the Court of Appeal on Homa Bay County gubernatorial election petition," he said.

Awiti added that the move was also influenced by his legal team's advice.

"Moreover, this decision heavily relies on the legal advise by my valuable legal team whom I wish to commend for their immense contribution to this legal process," he added.

While making the ruling on Thursday, the three-judge bench agreed with the petitioner and Awiti's main challenger in the race Oyugi Magwanga that the election held by the Independent Electoral and Boundaries Commission (IEBC) was not free and fair.

IEBC results indicated that Awiti garnered 210, 173 votes against Magwanga's 189, 060, with Magwanga, however, claiming that he won the race with a whooping 224, 836 against Awiti's 172, 235 according to his separate tally.
