The two were accused of allegedly fanning violence between the Borana and Gabra communities in Marsabit that seen 14 people lost their lives.

Appearing before Milimani Principal Magistrate Kennedy Cheruyiot, the two legislators did not plead to the charge.

The prosecution instead asked the court to detain the MPs for 21 days to enable completion of investigations.

The court, however ,declined to detain the MPs instead released them on Sh1 million bond or an alternative cash bail of Sh250, 000.

“I have considered the submissions and there is no proof that the accused persons will interfere with investigations or witnesses,” the court ruled.

The court directed the two legislators to report to DCI every week as investigations into the alleged incitement continues.

The MPs spend Monday night at Kileleshwa police station after they were arrested in Marsabit.

Last week, Marsabit Governor Ali Mohamud and the two MPs were separately interrogated over the deadly ethnic clashes between the Gabra and the Borana.

Governor Ali has since denied that the clashes are politically instigated instead blaming security agencies of failing to guarantee locals safety.

The Jubilee Governor says that Marsabit leaders are committed to ensure peace among communities in the county.
