It now emerges that a Kisumu bishop who was recently jailed for 75 years is planning to challenge the prosecution charge sheet in a bid to secure his freedom.
Joseph Agutu of the Faith Commission Ministry was jailed for 75 years by Justice Pauline Mbaluka at the Kisumu High Court
This was after he was convicted for defiling three minors and deliberately infected one of them with the HIV virus.
However, emerging details indicate that the pedophile is not new to such as he had earlier been jailed for 20 years in 2010 for defiling a 15-year old minor.
He would later succeed in securing his freedom through a successful petition, ending his three-year-stay behind bars.
Agutu was then a director of an orphanage in Oyugis, Homa Bay County before he relocated to Kisumu.
This is the similar scenario in the latest case where he also took advantage of the girls under his care in an orphanage he manages in Kisumu.
In the initial case, according to court records, Agutu took advantage of the girl who sought education assistance and defiled her in his office in 2007.
The victim testified that he demanded sex as payment for his efforts and commitment for her well being.
Agutu secured his release in 2013 after he successfully convinced a Kisii court that the charge sheet was defective.
He is reportedly planning to use the same narrative to again refute Justice Pauline Mbulika's judgment and secure his freedom from the Kodiaga Maximum Prison, reports the Standard.
