Kondele Social Justice Centre founder and team leader Boniface Ogutu Akach is all smiles after the Director of Public Prosecutions (DPP) Noordin Haji intervened and ordered for the withdrawal of an assault case against him.

The activist was arrested and charged before a Kisumu court in August, with the prosecution preferring charges of assaulting a police officer against him.

Haji’s Kisumu visit has, however, brought reprieve to the human rights defender as the DPP ordered for unconditional withdrawal of the case against him.

“I wish to thank the Director of Public Prosecutions who took it upon himself to personally study my case file before ordering for its complete unconditional withdrawal of the assault case against me and my co-accused. The magistrate has further ordered the police officers to give me back all items they took from me that they have been holding including my phone and bunch of keys,” Akach posted on Facebook.

“After a breakfast meeting this morning, we agreed that the responsible officers will not be transferred but prosecuted for malicious charge. The officers who assaulted me will also be prosecuted and made to pay for any of my properties that were destroyed,” he added.

Haji arrived in Kisumu on Tuesday for a series of meetings with activists and locals over various issues among them is what human rights defenders say are increasing cases of police brutality.
