After weeks of struggle, Walter Nyambati, the Nyamira County gubernatorial loser, will now have a chance to prove his case at the Supreme Court.
For the last three weeks, the petition against election of Govenor John Nyagarama, failed to kick-start due to laxity from his defense team.
In fact, on Monday morning, Supreme Court Registrar Ann Nyaiyaki asked the former Jubilee Chife Campaigner to withdraw the case albeit jokingly.
Mentioning was supposed to be done on 10th September but it had to be postponed twice to Monday (today).
Even after asking for more time in the morning, Nyambati would in the afternoon submit all the required documents for mentioning, precipitating the Registrar to admit the case.
Pre-trial conference for the petition, the first of its kind in the history of Nyamira, will take place on Friday, 5th October, the Registrar ruled.
Earlier, there were claims that Nyambati, a close ally of President Uhuru Kenyatta, was contemplating to withdraw the petition.
A lawyer, Mr. Osoro Mogikoyo, who worked for him in lower courts, claimed that he had withdrawn over non-payment.
The case involves lawyer Ombati Omwansa and Fred Ngatia for the petitioner and Mr. Jones Nyachiro for the respondent.
The Supreme Court duel is closely monitored by residents with some accusing Nyagarama of poor service delivery.
