A Nairobi court has freed a man who was facing charges of being caught in possession of a toy gun.

Patrick Kabuchi was arrested in 2015 in Kariobangi, with police details indicating that he was part of a gang which was being pursued by the police before his arrest.

The JamboJet employee, however, said that he was headed to his mother's house at the time, and was framed by the police, led by Dandora OCS Mathew Dogo for refusing to give a bribe.

While releasing him on Friday, Makadara Chief Magistrate Heston Nyaga said that the prosecution side failed to convince him, adding that he cannot rely on police testimonies alone.

"In my view, it will be a travesty of justice if he is convicted based on what prosecution witnesses told the court,” he ruled, according to the Nation.

Kabuchi also accused OCS Dogo of assaulting him after he refused to give the bribe, claiming that he sustained a deep cut in the head as a result.

He said that he, however, saw the OCS and his officers pursuing three people before they (the officers) pounced on him and took him along.

The OCS and four officers testified in court against Kabuchi.
