Harassment of Judicial officers by detectives informed Chief Justice David Maraga's decision to storm out of JSC meeting on Tuesday.
On Thursday morning, Maraga convened a meeting with other JSC commissioners where the legality in DCJ Philomena Mwilu's arrest was discussed.
"They discussed legality in Mwilu's debacles and how possible JSC can be involved," a lawyer said in confidence.
Before whisking Mwilu to DCI headquarters on Tuesday, DPP Noordin Haji held a meeting with Maraga where he explained his decision.
But lawyer Omwando Mbaka sensationally claims that the CJ stormed out of the meeting because 'he felt the law was not followed'.
"Even the CJ stormed out of the JSC meeting because he felt that legally, Haji messed up.
"He questioned the procedure band that's why he differed with them. Something went wrong with detectives on this," said the lawyer, who is part of boardroom team in the case.
Nyamira Senator Okong'o Mogeni obtained stay orders from High Court which effectively stopped Mwilu's prosecution.
According to him, detectives criminalised a commercial transaction.
"The law must be followed all the time and this is what we must fight for."
