Senior Counsel Ahmednasir Abdullahi has lauded the sentiments of Chief Justice David Maraga concerning the length of court cases in the country.
Quoting the CJ, Ahmednasir believes Maraga is correct to call on the country's justice system be at par with that of Singapore where the longest court case takes at most two years.
In a similar sense, Ahmednasir wants Kenyan court cases to take at most three years for them to be finalised.
"Judges will from now be working on a rotational basis moving to courts with huge backlogs. We want to be at par with Singapore where the longest pending case is about 2 yrs,' said CJ. Great idea CJ. Singapore has a mandatory 6 months to finalize a case..3 yrs will be great in Kenya," tweeted the lawyer on Friday.
Ahmednasir has, however, differed with the manner in which accused persons are being denied bail or bond by the judiciary.
In his view, the judiciary is denying accused persons bail or bond in a bid to appease the executive.
"That is why the 2010 constitution expressly provides the right to bail/bond as a fundamental human right. Since the retirement of CJ Mutunga, the Judiciary to appease the executive has adopted a judicial "policy" to deny accused persons the human right to bail/bond. What a tragedy!" added Ahmednasir.
