The trial of former Nairobi County Governor Evans Kidero over allegations of misappropriating Sh213 million will proceed to full trial, the High Court has ruled.

On Tuesday, High Court Judge John Onyiengo lifted temporary orders issued last week, suspending proceedings in Kidero’s graft case.

Justice Onyiengo ruled that Kidero will not suffer any prejudice if criminal proceedings against him in the lower court goes on, pending an appeal against charges facing him.

The Judge added that Kidero through his lawyers, did not give compelling reasons why the case against him in the magistrate court should be stopped.

“The applicant herein has not given any convincing reason to suspend the lower courts proceedings,” he ruled.

The Judge said that Kidero’s appeal will be heard in the shortest time possible, noting that there is no point for the former governor to worry.

Kidero is challenging a conspiracy charge against him, which he claims is defective and wants it removed from the charge sheet.

The troubled former governor also wants to be tried separately, in the case where he is charged with 10 other accused persons.

In March, anti-corruption court Chief Magistrate Douglas Ogoti dismissed Kidero’s application, prompting him to file an appeal in the High Court.

Kidero’s appeal at the High Court will be heard on May 14.
