Osman Abdi Dagane who had been arrested and charged in connection to the 2015 Garissa University college attack has been acquitted.Dagane who was working as a watchman at the university before the attack has been freed for lack of evidence.In his ruling on Tuesday, Nairobi Milimani Chief Magistrate Francis Andayi said the prosecution failed to link Dagane to the attack.Andayi said that Dagane’s phone forensic report ruled out any contact with terrorists.

“The allegation that he was found taking pictures at the scene of the attack was not proved, the accused person is hereby acquitted of all the charges,” the magistrate ruled.

The court, however, put on defence four suspects who had been charged alongside Dagane.

The four, Rashid Charles Mberesero, Mohamed Ali Abdikadir, Hassan Aden, and Sahal Diriye, have a case to answer.

The court said the prosecution proved a prima facie case against them.

The case will be mentioned on February 13 for directions.

One hundred and forty-seven people died in the Garissa university attack on April 2, 2015.
