The Court of Appeal in Kisumu has dismissed a petition challenging the re-election of Migori Governor Zachary Okoth Obado.

The ruling was delivered on Friday morning despite the petitioner having withdrawn the case a few days ago.

The petitioner, former minister Ochillo Ayacko withdrew the case against Obado in a bid to vie for the Migori County senatorial seat in October this year. 

The seat was left vacant following the death of Ben Oluoch Okello.

While delivering the ruling, Justice Steven Gatembu said the High Court did not err in throwing out the initial petition filed by Ochillo Ayacko.

He said that Ayacko failed to prove beyond reasonable doubt that governor Obado’s election on August 8th 2018 was not conducted within the law.

The court ordered Ochilo Ayacko,  to pay Sh3 million as the cost of the case.

On Thursday, the court of appeal in Kisumu threw out cases challenging the re-election of Kisii governor James Ongwae and his Nyamira Counterpart John Obiero Nyagarama.

The Court also dismissed a petition challenging the election of Kacheliba Member of Parliament Mark Lomunokol.

The court, however, ordered for fresh elections in Kabuchai Constituency after overturning the election of James Lusweti Mukwe.

The case against Mukwe’s election was filed by Edward Nabangi.
