Busia Governor Sospeter Ojaamong’ and other officials will be arrested due to tricksy in tendering and deceitful procurement procedures.
This is after Director of Public Prosecution Noordin Haji ordered for their arrest.
They will be charged with abuse of office and other offenses regarding procurement.
“Hon Sospeter Ojaamong unilaterally signed a Memorandum of Understanding (MOU) with Madam R Enterprise Ltd (MRE Ltd) in a project of solid waste management system without due regard procedural framework governing management of public finance and projects leading to loss of Ksh 8 million,” said Mr Haji.
Others include Timon Otieno Mboga, Mr Bernard Krade Yaite, Mr Lenard Wanda Obimbira among several others.
Investigation by the Ethics and Anti-Corruption Commission (EACC) back in the year 2016 revealed the tender was awarded improperly.
It also revealed that when the tender was awarded, the county paid another company with a similar name, Madam R which was registered as a sole proprietorship business.
“The first installment of Ksh4 million was made to Madam R Enterprises, and the second of Ksh4 million to MRE Ltd, which by then had been registered,” said Haji.
“Upon independent review of the file, I am satisfied that there is sufficient evidence to warrant prosecution. They should also be answerable to charges of engaging in a project without proper planning, abuse of office, and willful failure to comply with the law relating to management of funds.,” he added.
