The embattled governor filed an application at the apex court to have the ruling that barred him from accessing office nullified.

Waititu through the application expressed his dissatisfaction in the ruling by the Court of Appeal last Friday.

The Appellate Court upheld a previous ruling that barred governors from accessing office when facing graft allegations in court.

“Being dissatisfied with the entire decision of the Appellate Court, the applicant is seeking the Supreme Court’s intervention to enforce his rights as an elected governor and those of Kiambu people who stand to suffer if the decision is not overturned,” an appeal notice to the Supreme Court read.

Governor Waititu was, however, not the only county boss who was affected by the Court of Appeal's decision.

Samburu Governor Moses Lenolkulal and Nairobi Governor Mike Mbuvi Sonko, both of whom were barred from accessing office, suffered as a result of the ruling.

“We find nothing wrong with the lower court’s decision to bar the governors from accessing their offices. As much as it will be inconveniencing to them, we find that it is necessary to impose the conditions to safeguard public resources and the court’s integrity,” Court of Appeal judges ruled.
