The case involving Meru Senator Mithika Linturi and Marianne Kitany will continue to be held in public, magistrate Peter Gesora has ruled.

There was an application seeking to bar media coverage due to what the affected parties felt was misreporting. The two parties had asked the court to caution the media from making conclusions based on court proceedings.

Gesora ruled that the matter will remain public as earlier agreed with Linturi and his estranged wife Kitany. 

However, Gesora urged the media to stick to media ethics while covering the case.

In a recent court session, Kitany revealed what allegedly forced her to file the divorce. Narrating to Milimani Commercial Court Chief Magistrate Peter Ngare, Kitany claimed that the senator denied her conjugal rights and cheated on her.

“I filed for divorce because Linturi was cheating on me. He slept with other women in town. Linturi would come home late, and did not want to give me my conjugal rights,” Kitany told the court.

Senator Linturi has several setbacks as the case proceeds. In February 2019, the court restricted him from evicting Kitany from their Runda home. 

On June 3, 2019, a Nairobi court disqualified validity of a marriage certificate presented by the senator in court.
