The Kenya Railways has recovered its land in Kisumu which was initially occupied but two private developers.
With the help of the Ethics and Anti Corruption Commission (EACC), Kenya Railways has regained the land valued at Sh35 million under registration Kisumu Municipality/Block7/524.
The case was on Thursday presented before Kisumu Environment and Land Court judge SM Kibunja who ruled in favour of the railway company, according to Citizen Digital.
On their side, the investors; Okongo Oyoo and Sammy Komen Mwaita said that they leased the land from the Kisumu County Government, with the judge cancelling both leases.
This was in agreement with the EACC which also wanted the lease certificates awarded to the defendants revoked and the land to be given back to its rightful owner, the Kenya Railways.
To prevent the first defendant from leasing, transferring, charging, entering upon or developing the land, EACC wanted a permanent injunction against him and his agents.
EACC has filed to have him barred from interfering with the land in any way, seven months after Kenya Railways revealed that it has over 500 such cases pitting private developers.
