Independent Electoral and Boundaries Commission (IEBC) official are split over eligibility of footballer McDonald Mariga ahead of Monday ruling.

Mr Mariga was picked by Jubilee party to contest for Kibra constituency by-election, which has been scheduled for November 7th this year.

IEBC returning officer for Kibra, Ms Beatrice Muli, had early this week rejected Mariga's application, arguing that his name was not in the register.

On Friday, Starehe constituency IEBC official Yassin Ismael, confirmed that Mr Mariga had registered on 26th August this year, 10 days after the seat was declared vacant.

"On August 26, he came to our offices and I issued him with Form A, took his biometrics, before giving him the acknowledgement slip," he said.

Yassin, however, could not explain how he managed to capture Mariga’s details in the BVR kit without the footballer’s signature.

"That was an omission, we only realised that he (Mariga) had not signed the form after he had left," Yassin told Chebukati who wanted to know why the footballer did not sign the form.

But Ms Muli maintained that she followed due process, adding that Mariga's name could not be found in the commission's data base during that day.

According to her, the registration may have not been approved by the Commission, thus the delay in updating his name at KIMS kit which is officially recognized.

"We received Mariga document on September 10 and put them through the nomination process using our checklist but could not find his details," she said.

Muli said that the only way to know if a candidate is a registered voter is through checking his details in the KIEMS, a test Mariga failed.

"Upon presenting his ID cards, his details could not be found in the KIEMS, I had no otherwise," she said.

Also to be determined is whether Mariga can be allowed to contest since his name is not in the adopted register. IEBC will only use the last updated register of 2017.

There were also claims that Wafula Chebukati, who sits in the tribunal, had tried to pile pressure on Ms Muli to clear Mariga on Monday. The tribunal will issue a judgment in two days time (Monday).
