Nairobi Governor Mike Sonko on Wednesday filed an application in court, seeking a review on his bail terms.
Through his lawyer Harrison Kinyanjui, Sonko asked the High Court to quash an order by the Magistrate's court blocking him from accessing office.
He argued that chief magistrate Douglas Ogoti erred in his ruling, adding that he is innocent until proved guilty.
“My arraignment cannot create a vacancy in the office of the Governor of Nairobi City County to warrant Ogoti, to purport to direct me, to proceed and remove my personal items from office as though I had ceased having the right to access such office,” he said as quoted by the Star.
He now wants the High Court to quash Ogoti's order, until the case is heard and determined.
In the appeal, Sonko also wants the court to bar Nairobi County Assembly Speaking Elachi from assuming or occupying his office, arguing that no vacancy been announced.
Meanwhile, the governor failed to show up at the Voi Law Court on Wednesday, to answer to assault charges citing health reasons.
Sonko said he was at home recuperating following advice from his personal doctors.
The court was forced to postpone the case to January following the new development.
