Questions could emerge over the contradictions surrounding imprisonment and subsequent release of Nairobi Governor Mike Sonko from Shimo La Tewa prison.

In his previous public confessions, Sonko has often maintained that he escaped from prison where he was serving 12 months after being convicted of fraud.

But in a judgment issued by former High Court Judge Samuel Oguk in application No 80 of 2001, the late judge reduced Sonko's sentence by three months having served already 9 months on grounds that he was HIV positive.

"He was sentenced to serve 12 months imprisonment in respect of each count to run concurrently. He's now remaining with about three months to complete the sentence. The applicant has been distinguished as an HIV positive patient and this has been confirmed by medical evidence on record," reads the judgment which was revealed for the first time on Wednesday. 

"I do allow this application and I do hereby reduce the sentence that was imposed on the applicant in Mombasa case No 1727/96 and 675/97 to the period already served. So as to understand Sonko you might need to look at his past criminal record," added the judgment.

While Sonko's HIV status cannot be ascertained since he's never confessed anywhere in public, Nation Media Group investigative journalist Nyambega Gisesa claims that he faked his HIV status.

"Sonko faked his HIV status so as to get out of jail. He didn't escape as he keeps on telling people. Justice Oguk who issued the revision order for him to get out of jail, was sacked by the judiciary," Nyambega tweeted.

The county boss is not a stranger to controversy even after joining competitive politics in 2010. He was first elected to represent Makadara constituency before winning Nairobi senatorial elections in 2013.

Justice Oguk, who reduced Sonko's sentence, was sacked by the Judiciary during the radical surgery in 2008. He later died in 2016 in Mombasa having broken his bones.
