Solai Dam owners have been handed a reprieve after the court on Thursday lifted a warrant of arrest against them. The two businessmen, Manshukhlal Patel and Perry Kansagra landed in trouble after they allegedly forged a title deed.
The court had issued a warrant of arrest against the duo on Tuesday for allegedly using underhand tactics to own a 10-acre piece of land in Nairobi.
Makadara law courts Senior Principal Magistrate Angelo Kithinji lifted the ban after the businessmen made a formal application through their lawyer William Arusei.
The businessmen’s lawyer said the two were not aware of the forgery case they were being implicated in. The lawyer also said that they had not been summoned to appear before the court, adding that it was unlawful to issue the warrants of arrest against them.
“There were no summons served requiring them to appear in court. The court was misled into issuing the arrest warrants. They are ready to face their accusers when the time comes,” said Arusei.
Arusei said that they are innocent businessmen who legally paid for the said piece of land. He also said that the claims are aimed at scaring them so that they do not claim possession of the land.
The two businessmen have also been on the spot for the Solai dam tragedy which killed 47 people. The Solai dam case will be mentioned on January 6.
