The High Court in Nairobi has lowered former National Lands Commission (NLC) chairman Mohamed Swazuri's cash bail from Sh12 million to Sh7 million.

On Thursday, Justice Mumbi Ngugi lowered the cash bail for Swazuri and other accused persons but said that other bail terms set by the anti-corruption Magistrate court remain the same.

Swazuri moved to the High Court last week seeking review of his bail terms set by anti-corruption Chief Magistrate Lawrence  Mugambi.

He termed the Sh12 million cash bail as punitive, unconstitutional and unreasonable.

The embattled former NLC boss argued that he could not afford the bail.

The Director of Public Prosecution (DPP) Noordin Haji had opposed Swazuri's application for review.

The DPP argued that the Sh30 million bond or alternative of Sh12 million cash bail slapped on Swazuri by the anti-Corruption Court was reasonable and should not be reviewed.

The DPP asked Justice Ngugi to dismiss the application or enhance the bond terms against Swazuri and other accused persons.

Swazuri was slapped with a Sh12 million bail after pleading not guilty to charges of alleged fraudulent land compensation for construction of Mombasa Southern Bypass and Kipevu New High Terminal link Road in October 2013.

The former NLC chairman is alleged to have made irregular payments to Tornado Carriers Ltd for compulsory acquisition of land in Mombasa.

The suspects also pleaded not guilty to charges of conspiracy to commit economic crime, abuse of office, financial misconduct, money laundering and unlawful acquisition of public property.
