This comes only weeks after the High Court Judge Chacha Mwita ruled in favour of Wanjigi, ordering the police to return the seven guns taken from him.

In his appeal, Haji who expresses dissatisfaction with the ruling also wants the appellate court to squash Mwita's ruling that Wanjigi's gun licence be reinstated.

The DPP wants all rulings by the judge thrown out in their entirety

“Take notice that the DPP and DCI herein, being dissatisfied with the decision of Hon Mr Mwita ruling given on June 21, 2019, herein appeal to the Court of Appeal against the whole of the said decision,” reads the appeal according to the Standard.

In his ruling, Justice Mwita ruled that the police were at fault to take away his weapons despite having the proper certification to own and keep them.

“The actions by the respondents were unlawful and actuated by malice," he said last month.

Wanjigi's guns were confiscated after a raid on his home in Muthaiga, Nairobi in October 2027.

He blamed the harassment on his political fallout with the President Uhuru Kenyatta and Deputy President William Ruto duo whom he claimed he supported before their win in 2013.
