Director of Public Prosecution Noordin Haji insists that evidence tabled against Migori Governor Okoth Obado over Sharon Otieno's murder cannot warrant anything less than death sentence.
Justice Jessie Lessit will rule on application for bail made by Obado's defense team led by retired Judge Nicholas Ombija.
Through Jacob Ondari, Noordin says Obado planned and executed Sharon's murder with an aim of eliminating unborn baby who was likely to cause him political ridicule.
"We have established at this pre-trial that he was in constant communication with prime suspects and that he was at the murder scene.
"The only justice the deceased's family can get it handing him death sentence. The constitution has not abolished death sentence. It's dangerous to grant him bail since he might compromise investigations," he stated.
Earlier, Ombija had delinked his client from murder charges, insisting that he has never been mentioned directly.
Despite the spirited effort to get Obado out of Industrial Area prison, the defense team will now have to wait until October 24th.
Mr. Obado along with his aides Michael Oyamo and Caspal Obiero are accused of brutally murdering Sharon Otieno and her unborn baby.
