Former Sports Cabinet Secretary Rashid Echesa on Wednesday moved to a Kakamega court over what he terms as 'harassment' by state officers.
Mr Echesa was arrested last Friday over links to Matungu killings, but Director of Public Prosecutions (DPP) Noordin Haji ordered for his release on Sunday, along with that of Kakamega Senator Cleophas Malala.
Echesa's lawyer James Namatsi said the decision to move to court aims at barring the state from 'harassing' his client, who was kicked out of government in February.
“We want the court to prohibit the four from harassing Mr Echesa because we believe there is a political motive behind the arrests,” Mr Namatsi was quoted by the Nation.
“We want police permanently barred from harassing Mr Echesa," he added.
In the case, Attorney General Kihara Kariuki, IG Hillary Mutyambai, DPP Noordin Haji and DCI George Kinoti are listed as respondents.
Speaking after his release, Echesa accused Interior Cabinet Secretary Fred Matiang'i of orchestrating his predicaments.
“A team of county security officials called me saying CS Matiang’i had ordered my re-arrest. I want to know the minister’s involvement in all this,” he said.
Last week, Dr Matiang'i toured Matungu region where he vowed to have culprits arrested. He also deployed more GSU officers in the region.
"The days of those criminals who have been attacking villagers and killing them are numbered. From today, we are deploying the GSU and increasing the number of other security officers to restore sanity," he said.
