Businessman Jimi Wanjigi has been handed a reprieve after the High Court ordered the Directorate of Criminal Investigations and the National Police Service to return his seven guns.

The two agencies had raided the home of the tycoon in 2017 and took the guns.  

While delivering his ruling on Tuesday, High Court Judge Chacha Mwita said that the rights of the businessman had been violated by the agencies after they took his firearms under unclear circumstances. 

The officers had made their way into his Muthaiga before taking the guns. It emerged that the officers had embarked on the search mission without obtaining a warrant from the relevant office. 

The incident had taken place ten days after the rerun of the Presidential race following the nullification of President Uhuru Kenyatta and his Deputy William Ruto. 

The leaders allied to Former Prime Minister Raila Amolo Odinga faulted the officer for the search, saying it had been politically driven. The officers conducted the raid when his father and brother were present before leaving with the gun. 

The detectives reportedly destroyed the CCTV cameras at the home following the incident. The judge said that Wanjigi had presented the certificates for the guns. 

“Once a firearm certificate has been issued the police have no mandate to confiscate the holder’s firearm without lawful cause,” he said, as quoted by Daily Nation.
