The property row pitting Kisumu Governor Anyang Nyongo and his nephews seems to have begun after the county boss moved to the appellate court in a new encounter.
Nyongo and his sister Risper Nyagoy are said to be in a bid to have their nephews excluded from the list of beneficiaries of property left by his (Nyongo) father the late Shimei Nyongo.
This is after the High Court placed one of their nephews Kennedy Okudhe as a com administrator of the estate worth about Kshs 2, 000, 000.
In her ruling in October last year Justice Thrispisa Cherere removed Nyongo and Nyagoy as the sole controllers of the chain of properties, a ruling they are now out to fight.
The duo now wants the execution of the ruling to be halted until their new appeal is heard and determined by the higher court.
According to Nyongo' s lawyer Jefferson Museve, his clients are very confident that the appeal will be a success after their failure at the High Court.
"We feel the appeal has a high chance of success and therefore must be heard before any execution of the orders," he told the Nation.
The property in contention includes a large tract of land in Miwani, Muhoroni constituency and other pieces of land spread across Nairobi and Kisumu.
Earlier, Mr Okudhe had moved to court in a bid to have Nyongo and company jailed for six months for refusing to abide by the court order and hand over account books.
