Two police officers found themselves in trouble after they were arrested and detained on the orders of a Mombasa court on Thursday.
This is after the duo rearrested a group of five fraud suspects within the precincts of the court after their release by Mombasa Senior Principal Magistrate Henry Nyakweba.
Benson Kasugu, Eunice Mwende Ndolo, Felix Muia Ndolo, Evans Kenda Kiplagat and Edmond Kituri were set free after the prosecution failed to provide evidence against them.
The magistrate ordered that the group accused of defrauding the Kenya Commercial Bank of Ksh6, 793, 976 was free to go home and was not to be rearrested.
He ordered that they were to renain free until the prosecution had reorganized itself with sufficient evidence and ready to proceed with the case.
"The accused have been discharged and they are free to walk home.
They should not be arrested or take plea anywhere in relation to this case unless prosecution presses new charges on them," ruled justice Nyakweba, reports the Saturday Nation.
However, they were again nabbed by detectives outside the courtroom before being arraigned before the same court which caught the attention of Justice Nyakweba.
The magistrate ordered that the detectives be thrown in holding cells for three hours for trying to abuse the court process.
