Salaries and Remuneration Commission (SRC) through their lawyer Peter Wanyama has filed a petition on Friday over members of parliament house allowance.
The petition is not only seeking to recover already paid funds but also to stop further implementation of the same.
According to SRC, the allowance in question was paid illegally and didn't follow the constitutional structure of Remuneration and Benefits of all State Officers in Parliament.
They, therefore, seek the Parliamentary Service Commission (PSC) to answer with their Secretary Jeremiah Nyegenye.
"The decision of the Parliamentary Service Commission to set and pay MPs a house allowance is antithetical to the rule of law. In addition, it contradicts the express and clear constitutional provisions in Article 230(4) (a) that empower SRC to set and review the remuneration and benefits of all State officers. Moreover, the decision violates the provisions of Chapter Six of the Constitution on Leadership and Integrity,” the petition states as quoted by Daily Nation
The SRC further revealed lawmakers are comfortably renumerated. In their Sh 250, 000 house allowance for each of them, SRC explain that it will add up to Sh99.5 million loss of public money. This gives a summation of Sh1.194 billion per year.
Apart from of Sh109 per kilometre weekly mileage, lawmakers are entitled to Sh356,525 monthly car maintenance.
“They also receive a generous medical allowance for themselves, their spouses and as many as four children under 25 years. Other allowances include airtime, group life and personal accident cover, travel and notably, allowances for attending Parliament and sitting in committees."SRC revealed
