It is a reprieve for Narok County ECDE coordinator after a Nakuru’s Labor and Employment Relations court barred Narok County government from slashing the officer’s salary.

In an order, Justice Monica Mbaru temporarily stopped the county government of Narok from slashing the salary of Paul Kimetto Cheruiyot pending the hearing and determination of the case.

“The court hereby makes an order that the respondent is strained from further downgrading or slashing the petitioner’s remuneration or employment pending the hearing and determination of the application,” ordered Justice Mbaru.

Justice Mbaru also ordered the applicant to serve the respondents in the case within 14 days.

Through his lawyer, Peter Okiro, Kimetto sued Narok county government, Governor Samuel ole Tunai, the county secretary and Narok County Public Service Board.

“The actions of the respondents herein reducing the salary of my client were actuated by malice and ill will on part of the respondents contrary to the provision of the law,” said Okiro in an affidavit.

He further said that the respondents violated his rights to reasonable and procedurally fair administrative action contrary to article 47 of the constitution.

Kimetto was employed under job group N via a letter dated June 20, 2017 and was to be paid a monthly salary of Sh86, 480.

In March 2018, his salary was reduced to Sh 57,250.

In his affidavit, Kimetto said he wrote to the county secretary requesting for explanation to actions but there has been no response.

“On November 8, 2018, I wrote a letter through my advocate demanding an explanation to the reduction of my salary components but there has been no response. Therefore, prompting the constitutional petition before the court,” he said.

The court granted leave for the respondents to respond to the application within 14 days and the date for hearing be taken at the court’s registry.
