Despite Justice Jessie Lesiit ruling that condemned her to death sentence on Thursday, former Miss Lang'ata Prison winner Ruth Kamande will not be hanged.
In the next 14 days, Ms. Kamande, who was found guilty of murdering her boyfriend, will have a room to appeal the sentence.
But the Supreme Court ruling by Justice Njoki Ndung'u in 2017 declared death sentence unconstitutional thus making it unrealistic for Ms. Kamande to face the hangman.
In her ruling, Njoki said the section "is out of sync and cannot stand as it is inconsistent with the constitution".
But according to the office of the Attorney General however, the Supreme Court did not abolish the death penalty but only gave courts discretion of sentencing individual cases.
However, the AG office has since formed a taskforce that will review the sentence.
The last men to be hanged in Kenya were Air Force officers Private Hezekiah Ochuka and Oteyo Okumu over botched 1982 coup.
